Definitions

USER: Anyone who accesses the PORTAL, even if they do not make any purchase, and who uses, accesses, or has access to the CONTENT displayed therein.

CONTENTS: Any information, text, link, software, material, tools (including photos of Products and Services Offered), etc., whose availability and access occur exclusively online through the PORTAL and by browsing it.

REGISTERED USER: Any USER who registers on the PORTAL by completing the registration form and who can access the private user area available on the PORTAL.

LEGAL NOTICES: All general and specific conditions displayed on the PORTAL, in addition to any applicable legal regulations.

SPAM: Defined for the purposes of these general conditions as the indiscriminate sending of messages to email accounts without prior authorization from the owners of the email addresses.

1. PURPOSE

Justloading.com, through the PORTAL, provides the user with access to a series of CONTENT that may be supplied or provided either by Justloading.com itself or by third parties, with the main purpose of providing commercial information. Within the PORTAL itself, there may be areas with free or restricted access and use of the CONTENT. In this case, access will be granted through the introduction of a USERNAME and PASSWORD assigned to the USER in accordance with the provisions of section B.4 of these general conditions.

Justloading.com reserves the right to limit, interrupt, or suspend access to the PORTAL and the use of all or some of its CONTENT, whether freely accessible or restricted, at any time. Likewise, Justloading.com reserves the right to modify at any time the location of the CONTENT on the PORTAL, as well as the configuration of both the CONTENT itself and access thereto, including the design of the PORTAL.

1. CONDITIONS OF ACCESS AND USE OF THE PORTAL

B.1. General access and use of the PORTAL by a USER.

The USER expressly and unequivocally accepts that access to and use of the PORTAL does not imply any type of guarantee, which Justloading.com expressly disclaims, regarding the suitability of the contents included therein for the USER’s particular or specific purposes. Consequently, both access to the PORTAL and use of the CONTENT are carried out under the USER’s sole responsibility, and Justloading.com shall not be liable in any case or to any extent, whether for direct or indirect damages, consequential damages, or loss of profit, for any damages arising from the use of the CONTENT or from the conclusions drawn by the USER from such use, whether accessible on the PORTAL or on other websites through existing connections and links. Likewise, Justloading.com shall in no case be liable, even indirectly or subsidiarily, for CONTENT, products, or services provided or offered by third parties or entities (nor for their marketing and manufacturing conditions), or for contents, information, communications, opinions, or statements of any kind originating from third parties and accessible through the PORTAL, which shall not under any circumstances constitute a guarantee or endorsement for the use or acquisition of products or services from third-party suppliers.

The USER expressly and unequivocally accepts that Justloading.com may establish at any time additional conditions or restrictions for access to the PORTAL and use of the CONTENT, which shall be immediately binding on the USER without prior notice.

Access to the PORTAL is provided in good faith by Justloading.com, and given that much of the CONTENT may be supplied or provided by third parties, Justloading.com warns and the USER acknowledges and accepts that some of the data or texts available may not be entirely accurate or updated, despite Justloading.com making its best efforts to ensure otherwise. Therefore, Justloading.com shall be solely responsible for contents directly provided by Justloading.com and expressly identified with its Copyright.

B.2. Authorized Use of the PORTAL and Contents.

The USER expressly and unequivocally declares that they will access the PORTAL and, where applicable, use it and the CONTENT therein in accordance with the legal notices, these general conditions, any specific conditions applicable to each CONTENT, as well as all other applicable regulations, good practices and customs, good faith, and public order. In any case, and purely by way of example, the USER undertakes to:

1. a) Not access or use the PORTAL or its CONTENT in ways that are unauthorized or contrary to the purpose of the PORTAL and the regulatory framework governing it. Thus, the USER shall not access or attempt to access or use CONTENT and/or RESTRICTED areas of the PORTAL without proper authorization. Furthermore, the USER shall access and use restricted areas using the procedures and tools established by the PORTAL itself, and under no circumstances, whether authorized or not to access and use restricted areas and CONTENT, may the USER use any procedures, means, or computer tools intended to bypass the security and identification measures established by Justloading.com or third parties.
2. b) Access and/or use the PORTAL and/or the CONTENT within the principles and purposes for which they were created and made available to the USER, also respecting the format in which they are made available and the legal notices set forth herein. In order to comply with these principles and purposes, the USER undertakes, by way of example and not limitation, to: 1) not perform or attempt to perform actions that may directly or indirectly cause damage, generally to the PORTAL and the CONTENT therein, and specifically to the rights of Justloading.com or any third party. 2) Not perform or attempt to perform actions that affect, including modifying, manipulating, or deleting references or formats of references or notices regarding the protection of intellectual or industrial property rights of Justloading.com or third parties, whether on the PORTAL itself, the CONTENT therein, or other ELEMENTS composing it. 3) Perform actions that damage or may damage the systems of Justloading.com or third parties, or that may affect or disrupt the normal development of the purpose of the PORTAL. These actions include introducing computer viruses into the systems of Justloading.com, USERS, or any third party that affect or may affect the PORTAL in any way, as well as actions aimed at spreading such viruses on the PORTAL or through the network via the PORTAL.
3. c) Not place any false or fraudulent orders. If it could reasonably be considered that such an order has been placed, we will be authorized to cancel it and inform the relevant authorities.
4. d) Provide us with your email address, postal address, and/or other contact details truthfully and accurately. Likewise, you agree that we may use this information to contact you if necessary.
5. e) The USER shall be liable for all damages and losses, of any nature, that Justloading.com, any other USER, or a third party may suffer as a consequence of improper use of the PORTAL or the CONTENT therein. Likewise, they shall be liable for any amount that Justloading.com may be required to pay as a consequence of an administrative decision, final court ruling, or settlement agreement aimed at compensating third parties for damages caused for the same reason.

B.3 The contents:

The USER expressly and unequivocally declares that they undertake not to reproduce or copy, distribute, allow public access through any form of public communication, transform or modify the CONTENT, unless authorized by the holder of the corresponding rights or legally permitted, as well as not to circumvent or attempt to circumvent the protection devices or any information mechanisms that may be inserted in the referred Contents, such as the protection of intellectual or industrial property rights therein.

The USER undertakes NOT to obtain or attempt to obtain the Contents using means or procedures other than those made available for this purpose or expressly indicated on the web pages where the CONTENT is located, or generally those commonly used on the Internet provided they do not entail a risk of damage or disabling of the PORTAL and/or the CONTENT.
